Terms of Use

These terms and conditions (“Agreement”) apply to your use of Cloud Pay (“the App”), a mobile application developed and owned by Cloud Energy, for the purpose of accessing solar leasing and bill payment services. By using the App, you agree to be bound by these terms and conditions, which constitute a legal agreement between you and Cloud Energy.

Registration and Account

(a) You must register and set up an account to use the App. You must provide accurate and complete information during registration and keep your account information updated at all times.

(b) You must be at least 18 years old and a resident of Nigeria to use the App.

(c) You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

(d) You agree not to use the App for any unlawful purpose or in violation of any applicable laws or regulations.

Solar Leasing

(a) The App allows you to lease solar products by making monthly payments through your bank account.

(b) You agree to pay the agreed monthly payment and understand that failure to do so may result in termination of the lease agreement.

(c) You acknowledge that ownership of the leased solar product remains with Cloud Energy until the full lease amount is paid.

(d) You agree to use the solar product in a responsible and safe manner and to follow the manufacturer’s instructions for use.

(e) You agree to pay for any damage caused to the leased solar product due to your misuse or negligence.

Bill Payment

(a) The App allows you to pay your electricity bills and other bills through the platform.

(b) You are responsible for ensuring that all the details you provide when paying bills are accurate and complete.

(c) You acknowledge that Cloud Energy is not responsible for any errors or inaccuracies in bill payments made through the App.

Termination

(a) Cloud Energy reserves the right to terminate your use of the App at any time and for any reason without notice.

(b) You may terminate your use of the App at any time by deleting your account.

Intellectual Property

(a) The App and all its content, including but not limited to text, graphics, logos, images, and software, are the property of Cloud Energy and are protected by Nigerian and international copyright and trademark laws.

(b) You may not use the App or its content for any commercial or non-personal purpose without the express written consent of Cloud Energy.

Disclaimer of Warranties

(a) The App is provided on an “as is” and “as available” basis. Cloud Energy makes no representations or warranties of any kind, express or implied, regarding the App or its operation.

(b) Cloud Energy does not warrant that the App will be error-free or uninterrupted, or that any defects will be corrected.

(c) Cloud Energy makes no warranty that the App will meet your requirements or that it will be suitable for any particular purpose.

Limitation of Liability

(a) Cloud Energy shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App.

(b) Cloud Energy’s liability under this Agreement shall not exceed the total amount of fees paid by you to Cloud Energy for the use of the App.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

 

Entire Agreement

This Agreement constitutes the entire agreement between you and Cloud Energy and supersedes all prior agreements and understandings, whether written or oral, relating to the App.
